Scope of Licence ---------------- This licence is applicable only to home users and small business users. If any of the above applies to you, you may not use the software under this licence. You must contact Update Computer Services for a publishers licence. Exceptions may be made to religious, charitable or educational organizations, though no specific exceptions are implied. Licence Statement ----------------- This software is protected by copyright law and international copyright treaty. You may make archive copies of the software for the sole purpose of backing up our software and protecting your investment from loss. This software may not be used by more than one person, and may not be freely moved from one computer or location to another. The software cannot be used by two different people on two different machines at the same time without Update Computer Services permission (such use constitutes a breach of this licence and warranty). Adding users ------------ You may add users by paying for a separate software package for each user you wish to add. You may also add users by purchasing LAN packs/LAN licences (for use through a local area network only), multi-user versions, or additional licences for the software, so long as the number of persons who are able to use the software at one time is not more than the number of authorized users specified in our package or licence. The number of authorized users is not increased if Update Computer Services simply puts more than one type of media (such as 3.5- and 5.25-inch diskette) in the software package. Transferring the software ------------------------- If you have purchased an upgrade version of the software, it constitutes a single product with the Update Computer Services software that you upgraded. For example, the upgrade and the software that you upgraded cannot both be available for use by two different people at the same time, and cannot be transferred separately, without written permission from Update Computer Services. This software is subject to United Kingdom export restrictions, and is intended for use in the country into which Update Computer Services sold it. Except as provided in this statement, you may not transfer, rent, lease, lend, copy, modify, translate, sublicence, time-share, or electronically transmit or receive the software, media, or documentation. You may transfer all of your rights to use the software to another person, provided that you transfer to that person all of the software, diskettes, and documentation provided in this package (including this statement), and transfer or destroy all copies in any form. Remember, once you transfer the software you no longer have any right to use it, and the person to whom it is transferred may use it only in accordance with the copyright law, international treaty, and this statement. Limited warranty ---------------- Update Computer Services warrants the physical media and physical documentation provided by Update Computer Services to be free of defects in materials and workmanship for a period of ninety (90) days from the original purchase date. If Update Computer Services receives notification within the warranty period of defects in materials or workmanship, and determines that such notification is correct, Update Computer Services will replace the defective media or documentation. Do not return any product until you have called the Update Computer Services customer support department. The entire and exclusive liability and remedy for breach of this limited warranty shall be limited to replacement of defective media or documentation and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of incidental or consequential damages, or other similar claims, even if Update Computer Services has been specifically advised of the possibility of such damages. In no event will Updates Computer Services liability for any damages to you or any other person ever exceed the lower of the list price or the actual price paid for the package or the licence to use the software, regardless of the form of the claim. Update Computer Services specifically disclaims all other warranties, representations, or conditions, express or implied, including but not limited to, any implied warranty or condition of merchantability or fitness for a particular purpose. All other implied terms are excluded. Specifically, Update Computer Services makes no representation or warranty that the software or documentation are error free, or meet any user's particular standards, requirements, or needs. In all events, any implied warranty, representation, condition, or other term is limited to the physical media and documentation and is limited to the 90-day duration of the limited warranty. Update Computer Services is not responsible for, and does not make any representation, warranty, or condition concerning product, media, software, or documentation not manufactured or supplied by Update Computer Services, such as third parties` software used with Update Computer Services software or which include Update Computer Services programs or files. General Provisions ------------------ This statement may only be modified in writing signed by you and an authorized officer of Update Computer Services. If any provision of this statement is found void or unenforceable, the remainder will remain valid and enforceable according to its terms. If any remedy provided is determined to have failed of its essential purpose, all limitations of liability and exclusions of damages set forth in the limited warranty shall remain in effect. Use, duplication, or disclosure of the software and documentation in this package by the Government of the United Kingdom is subject to commercial computer software. This statement shall be constructed, interpreted and governed by the laws of the United Kingdom. (UK statutory rights are not affected or prejudiced as to software acquired other than in the course of a business).
